Article 1 – Definitionsthese terms and conditions, the following definitions apply:

- Faress Studio / we / us: the online store Faress Studio, based in the Netherlands.

- Customer / you: the natural or legal person placing an order with Faress Studio.

- Agreement: the agreement between Faress Studio and the customer, including product purchases through the webshop.

- Products: all clothing items and related goods offered through our webshop.

- Day: calendar day.

 

Article 2 – Applicability

1. These terms and conditions apply to all products, orders, and agreements with Faress Studio.

2. Deviations are only valid if agreed upon in writing.

3. Faress Studio may update these terms; the most recent version applies to new orders.

 

Article 3 – Formation of the Agreement

1. The agreement is established once you receive an order confirmation from Faress Studio.

2. If an item becomes unavailable, we may cancel the order. You will be informed and refunded.

 

Article 4 – Prices and Payment

1. All prices are in euros and include VAT.

2. Shipping costs are shown before checkout.

3. Payment is made via available payment methods.

4. Payment methods may be adjusted or expanded.

 

Article 5 – Delivery

1. We aim to ship orders within the indicated time.

2. Delivery takes place at the address you provide.

3. If delivery is delayed, you will be notified and may cancel.

4. Risk of loss or damage passes to the customer upon shipment.

 

Article 6 – Right of Withdrawal & Return Policy (Clothing)

1. Consumers have the right to withdraw within 14 days of receiving the order.

2. Returns are accepted only if the clothing item is returned in its original condition:

  - unworn

  - unwashed

  - undamaged

  - all original labels and tags attached

  - free of odors or makeup stains

3. Return shipping costs are the responsibility of the customer unless otherwise stated.

4. Returns must first be reported via email or the return form.

5. After reporting, the product must be returned within 14 days.

6. All returned items are inspected by Faress Studio. Refunds are issued only if the item is approved after inspection.

7. Refunds will be issued within 14 days after approval.

8. If the item is not returned in original condition, the return may be refused or a depreciation amount applied.

9. Hygiene-sensitive products (e.g., underwear) can only be returned unopened and sealed.

 

Article 7 – Warranty and Conformity

1. Our products must meet reasonable expectations.

2. Legal warranty applies.

3. Defects must be reported within a reasonable period.

4. We offer repair, replacement, or refund for valid defects.

 

Article 8 – Liability

1. Faress Studio is not liable for indirect damages.

2. Direct liability is limited to the order amount unless caused by intent or gross negligence.

3. Faress Studio is not liable for damage caused by improper use of products.

 

Article 9 – Force Majeure

1. In cases of force majeure, obligations may be suspended or canceled.

2. If force majeure lasts longer than 60 days, the customer may cancel without costs.

 

Article 10 – Complaints and Disputes

1. Complaints may be submitted via email or contact form.

2. We strive for proper resolution.

3. If unresolved, customers can contact dispute mediation bodies or courts.

4. Dutch law applies.

 

Article 11 – Intellectual Property

1. All content is protected by copyright or other intellectual property rights.

2. Use without written permission is prohibited.

 

Article 12 – Privacy (in accordance with GDPR)

1. Faress Studio processes personal data in accordance with the GDPR. In accordance with European law.5

2. We only process data necessary for fulfilling orders and customer service.

3. Our privacy policy explains what data we collect and why.

4. Customers have rights such as access, correction, and deletion.

5. Use of our website constitutes acceptance of the privacy policy.

 

Article 13 – Changes

Faress Studio may amend these terms. The latest version is always posted on the website.

 

 

Algemene Voorwaarden Faress Studio (Kledingwebshop) 

Artikel 1 – Definities

In deze algemene voorwaarden wordt verstaan onder:

- Faress Studio / wij / ons: de webwinkel Faress Studio, gevestigd in Nederland.

- Klant / u / jij: de natuurlijke persoon of rechtspersoon die bij Faress Studio een bestelling plaatst.

- Overeenkomst: de overeenkomst tussen Faress Studio en de klant, inclusief aankoop van producten via de webshop.

- Producten: alle kledingstukken en aanverwante artikelen die via onze webshop worden aangeboden.

- Dag: kalenderdag, tenzij anders vermeld.

 

Artikel 2 – Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op alle producten, bestellingen en overeenkomsten van Faress Studio.

2. Afwijkingen zijn alleen geldig wanneer schriftelijk overeengekomen.

3. Faress Studio mag de voorwaarden wijzigen; de nieuwste versie geldt voor nieuwe bestellingen.

 

Artikel 3 – Totstandkoming van de overeenkomst

1. De overeenkomst komt tot stand zodra je van ons een orderbevestiging ontvangt.

2. Indien een kledingitem niet meer leverbaar blijkt, mogen wij de bestelling annuleren. Je wordt hierover geïnformeerd en betaalde bedragen worden teruggestort.

 

Artikel 4 – Prijzen en betaling

1. Alle prijzen zijn in euro’s en inclusief btw.

2. Eventuele verzendkosten worden voorafgaand aan de bestelling getoond.

3. Betaling verloopt via de aangeboden betaalmethoden.

4. Betaalmethoden kunnen worden aangepast of uitgebreid.

 

Artikel 5 – Levering

1. Wij streven naar verzending binnen de aangegeven termijn.

2. Levering vindt plaats op het door jou opgegeven afleveradres.

3. Indien de levertijd wordt overschreden, word je hiervan op de hoogte gebracht en kun je annuleren.

4. Het risico van verlies of beschadiging gaat over op de klant bij verzending.

 

Artikel 6 – Herroepingsrecht & Retourbeleid (Kleding)

1. Consumenten hebben recht op herroeping binnen 14 dagen na ontvangst van de bestelling.

2. Retourneren kan alleen als het kledingstuk in originele staat wordt teruggestuurd:

  - ongedragen

  - ongewassen

  - zonder beschadigingen

  - met alle originele labels en tags bevestigd

  - vrij van geuren en make-upsporen

3. Retourkosten zijn voor rekening van de klant, tenzij anders vermeld.

4. Retour dient eerst gemeld te worden via e-mail contact@faress-studio.com

5. Na melding moet het artikel binnen 14 dagen worden teruggestuurd.

6. Retouren worden beoordeeld door Faress Studio. Alleen wanneer het artikel in originele staat is, wordt de retour goedgekeurd.

7. Terugbetaling vindt binnen 14 dagen na goedkeuring plaats.

8. Indien het artikel niet in originele staat terugkomt, kan de retour worden geweigerd of wordt een waardevermindering toegepast.

9. Hygiënische producten (zoals onderkleding) kunnen alleen retour als deze ongeopend en verzegeld zijn.

 

Artikel 7 – Garantie en conformiteit

1. Onze kledingproducten moeten voldoen aan redelijke verwachtingen.

2. Wettelijke garantie is van toepassing.

3. Gebreken dienen binnen redelijke termijn gemeld te worden.

4. Wij bieden reparatie, vervanging of restitutie bij gegronde gebreken.

 

Artikel 8 – Aansprakelijkheid

1. Faress Studio is niet aansprakelijk voor indirecte schade.

2. Directe schade is beperkt tot het bedrag van de bestelling, tenzij sprake is van opzet of grove nalatigheid.

3. Faress Studio is niet aansprakelijk voor schade door verkeerd gebruik van producten.

 

Artikel 9 – Overmacht

1. Bij overmacht mogen wij verplichtingen opschorten of annuleren.

2. Indien overmacht langer dan 60 dagen duurt, mag de klant kosteloos annuleren.

 

Artikel 10 – Klachten en geschillen

1. Klachten kunnen ingediend worden via e-mail contact@faress-studio.com

2. Wij streven naar correcte afhandeling.

3. Als dit niet lukt, kan de klant naar de Geschillencommissie of de rechter.

4. Nederlands recht is van toepassing.

 

Artikel 11 – Intellectuele eigendom

1. Alle content is beschermd.

2. Gebruik zonder toestemming is verboden.

 

Artikel 12 – Privacy (in overeenstemming met de AVG)

1. Faress Studio verwerkt persoonsgegevens in overeenstemming met de AVG.

2. Wij verwerken alleen gegevens die nodig zijn voor bestellingen en service.

3. Onze privacyverklaring beschrijft welke gegevens wij verzamelen en waarom.

4. Klanten hebben rechten zoals inzage, correctie en verwijdering.

5. Gebruik van onze website betekent akkoord met de privacyverklaring.

 

Artikel 13 – Wijzigingen

Faress Studio mag deze voorwaarden aanpassen. Op de website staat altijd de meest recente versie.
